{"id":923,"date":"2022-09-20T17:09:35","date_gmt":"2022-09-20T16:09:35","guid":{"rendered":"https:\/\/www.mediadefence.org\/ereader\/?post_type=publication&#038;p=923"},"modified":"2022-09-22T11:50:13","modified_gmt":"2022-09-22T10:50:13","slug":"what-is-network-neutrality","status":"publish","type":"publication","link":"https:\/\/www.mediadefence.org\/ereader\/publications\/modules-on-litigating-freedom-of-expression-and-digital-rights-in-south-and-southeast-asia\/module-3-access-to-the-internet\/what-is-network-neutrality\/","title":{"rendered":"What is Network Neutrality?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Network neutrality \u2014 or \u201cnet neutrality\u201d \u2014 refers to the principle that there should be no discrimination in the treatment of Internet data and traffic, based on the device, content, author, origin and\/or destination of the content, service or application.[footnote]2017 Report of the UNSR on freedom of expression above at n 18 at para 23.[\/footnote] In other words, ISPs should treat all data that travels over their networks fairly, without improper discrimination in favour of a particular application, website or service.[footnote]Electronic Frontier Foundation, \u2018Net neutrality\u2019 (accessible at: <a href=\"https:\/\/www.eff.org\/issues\/net-neutrality\">https:\/\/www.eff.org\/issues\/net-neutrality<\/a>).[\/footnote] Discrimination in this regard may relate to affecting information in a way that halts, slows or otherwise tampers with the transfer of any data, except for a legitimate network management purpose, such as easing congestion or blocking spam.[footnote]American Civil Liberties Union, \u2018What is net neutrality?\u2019 (accessible at: <a href=\"https:\/\/www.aclu.org\/issues\/free-speech\/internet-speech\/what-net-neutrality\">https:\/\/www.aclu.org\/issues\/free-speech\/internet-speech\/what-net-neutrality<\/a>).[\/footnote] <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 2017 Report of the UNSR on freedom of expression describes two key ways in which net neutrality may be effected[footnote]2017 Report of the UNSR on freedom of expression above n 18 at paras 24-28.[\/footnote]:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Paid prioritisation schemes<\/strong> \u2014 where providers give preferential treatment to certain types of internet traffic over others for payment or other commercial benefit.<\/li><li><strong>Zero-rating<\/strong> \u2014 which is the practice of not charging for internet data associated with accessing a particular application or set of services while such data is charged to access other services or applications.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In various countries in Asia, there has been significant debate about access to zero\u2011rated content, as particularly social networking sites offer some measure of free access to users. &nbsp;On the one hand, the social media companies that promote them argue that zero-rating provides access to people who might not otherwise have been able to access the internet and can serve as a gateway to users to understand the opportunities that the internet can offer. In practice, however, these people often get stuck just accessing the privileged services and, indeed, may even think that these comprise the whole internet. &nbsp;On the other hand, zero\u2011rating leads to unfair competition and can distort users\u2019 perceptions by only allowing access to particular sites.[footnote]For an overview of legal treatment of zero-rating schemes globally, see Centre for Law and Democracy\u2019s 2022 <em>amicus curiae<\/em> submissions before the Constitutional Supreme Court in the proceeding of D-14516 on Ley 1450 de 2011, paras. 101-112 (accessible at: <a href=\"https:\/\/www.law-democracy.org\/live\/wp-content\/uploads\/2022\/02\/Colombia.Zero-Rating-Brief.CLD_.final_.pdf\">https:\/\/www.law-democracy.org\/live\/wp-content\/uploads\/2022\/02\/Colombia.Zero-Rating-Brief.CLD_.final_.pdf<\/a>).[\/footnote]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India is among the jurisdictions to have taken action against zero rating, effectively banning it. A 2016 regulation prohibited Internet access providers from offering or charging discriminatory tariffs for data services on the basis of content, with only a limited exception for zero rating for emergency services.[footnote]Telecom Regulatory Authority of India, Notification No. 2 of 2016, Prohibition of Discriminatory Tariffs for Data Services Regulations (2016) (accessible at: <a href=\"https:\/\/trai.gov.in\/sites\/default\/files\/Regulation_Data_Service.pdf\">https:\/\/trai.gov.in\/sites\/default\/files\/Regulation_Data_Service.pdf<\/a>).[\/footnote] The regulation was enacted following an active campaign by digital rights activists in India.
