{"id":350,"date":"2024-06-13T12:46:00","date_gmt":"2024-06-13T11:46:00","guid":{"rendered":"https:\/\/www.mediadefence.org\/ereader\/?post_type=publication&#038;p=350"},"modified":"2024-06-25T16:29:56","modified_gmt":"2024-06-25T15:29:56","slug":"what-is-an-internet-shutdown","status":"publish","type":"publication","link":"https:\/\/www.mediadefence.org\/ereader\/publications\/introductory-modules-on-digital-rights-and-freedom-of-expression-online\/module-3-access-to-the-internet\/what-is-an-internet-shutdown\/","title":{"rendered":"What is an Internet Shutdown?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">An internet shutdown may be defined as an intentional disruption of internet or electronic communications, rendering them inaccessible or effectively unusable, for a specific population or within a location, often to exert control over the flow of information.[footnote]Access Now, \u2018What is an internet shutdown?\u2019 (accessible at https:\/\/www.accessnow.org\/keepiton\/?ignorelocale).[\/footnote] In other words, this arises when someone, be it the government or a private sector actor, intentionally disrupts the internet, a telecommunications network or an internet service, arguably to control or curb what people say or do.[footnote]<em>Id.<\/em>[\/footnote]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is sometimes also referred to as a \u2018kill switch.\u2019 Shutdowns remain a pressing concern:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In 2022, 187 internet shutdowns access 35 countries were recorded.[footnote]Access Now \u2018Who is shutting down the internet in 2023? A mid-year update\u2019 (2023) (accessible at https:\/\/www.accessnow.org\/campaign\/keepiton\/).[\/footnote]<\/li>\n\n\n\n<li>Between January and May 2023, Access Now recorded 80 internet shutdowns in 21 countries.[footnote]<em>Id.<\/em>[\/footnote]<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The scope and scale of a shutdown may vary:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In some instances, this may entail there being a total network outage, whereby access to the internet is shut down in its entirety.<\/li>\n\n\n\n<li>In others, it may be access to mobile communications, websites, or social media and messaging applications that are blocked, throttled, or rendered effectively unusable.[footnote]UNHRC, \u2018Report of the UNSR on Freedom of Expression\u2019 (2017) (accessible at https:\/\/documents-dds-ny.un.org\/doc\/UNDOC\/GEN\/G17\/077\/46\/PDF\/G1707746.pdf?OpenElement) at para 8.[\/footnote]<\/li>\n\n\n\n<li>Shutdowns may affect an entire country, specific towns or regions within a country, or even multiple countries, and have been seen to range from several hours to several months.[footnote]<em>Id.<\/em>[\/footnote]<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It should be noted that in order to conduct shutdowns, governments typically require the action of private actors that operate networks or facilitate network traffic.[footnote]<em>Id.<\/em>[\/footnote]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As noted by the United Nations Special Rapporteur on Freedom of Expression (UNSR on FreeEx), large-scale attacks on network infrastructure committed by private parties, such as distributed denial-of-service (known as \u2018DDoS\u2019) attacks, may also have shutdown effects.<\/p>\n\n\n\n<div class=\"wp-block-group highlight\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading has-text-align-center\"><strong><strong>Jurisprudence on internet shutdowns<\/strong><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In a landmark case confirming that internet shutdowns constitute a form of prior restraint and an unjustifiable infringement on freedom of expression, in June 2020, the Economic Community of West African States (ECOWAS) Community Court of Justice (ECOWAS\u00a0Court) ruled in <a href=\"https:\/\/globalfreedomofexpression.columbia.edu\/wp-content\/uploads\/2020\/07\/Amnesty-International-et.al-v.-Togo-Motion-for-Leave-to-File-Amicus-Brief-ECOWAS-ENGLISH.pdf\"><em>Amnesty International v. Togo<\/em><\/a> that the internet shutdowns implemented by the <strong>Togolese<\/strong> government in 2017 were illegal.[footnote]<em>Amnesty International Togo v The Togolese Republic<\/em> (2020) (accessible at https:\/\/globalfreedomofexpression.columbia.edu\/cases\/amnesty-international-togo-and-ors-v-the-togolese-republic\/).[\/footnote] In the judgment, the ECOWAS Court held that access to the internet is a \u201cderivative right\u201d as it \u201cenhances the exercise of freedom of expression\u201d and as such is \u201ca right that requires protection of the law.\u201d<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In a similar case in 2022 relating to the blocking of specific content, rather than a wholesale internet shutdown, the ECOWAS Court in <a href=\"https:\/\/globalfreedomofexpression.columbia.edu\/cases\/serap-v-federal-republic-of-nigeria\/\"><em>SERAP v. Federal Republic of Nigeria<\/em><\/a> considered the government of <strong>Nigeria\u2019s<\/strong> banning of social media platform Twitter, underscoring that modern technology has enabled the exchanges of ideas, views, and opinions and thus furthers freedom of expression, and held that access to Twitter is a \u201cderivative right\u201d that is \u201ccomplementary to the enjoyment of the right to freedom of expression.\u201d[footnote]<em>SERAP v. Federal Republic of Nigeria<\/em> (2022) (accessible at https:\/\/globalfreedomofexpression.columbia.edu\/cases\/serap-v-federal-republic-of-nigeria\/).[\/footnote]<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In 2023, the <strong>Colombian<\/strong> Constitutional Court held in <a href=\"https:\/\/globalfreedomofexpression.columbia.edu\/cases\/bejarano-ricaurte-and-others-v-ministry-of-defense-and-others\/\"><em>Bejarano v. Ministry of Defense<\/em><\/a> that the government had violated the rights to freedom of expression, association and assembly due to their failure to provide petitioners with timely, truthful, and complete information about internet shutdowns during public protests that occurred in 2021.[footnote]Global Freedom of Expression: Columbia University, \u2018<em>Bejarano v.
