Heather Rogers has appeared in numerous high-profile cases, representing clients as varied as Private Eye, Channel 4, the MP George Galloway and the film director Roman Polanski. She has also done several cases for MLDI, including at the European Court of Human Rights where she argued a case concerning the right of the media to report remarks made about the then-chancellor of Germany by the leader of the opposition.

Among many high-profile cases in which he has been involved, Mark represented the Washington Post correspondent Jonathan Randal at the International Criminal Tribunal on the former Yugoslavia at the Hague, which sought to compel the reporter to give evidence during a hearing on alleged genocide. He argued on Randal’s behalf that if journalists covering conflicts might be required to testify at subsequent war crimes trials this would put them at risk while doing their job.

In the wake of a heavy defeat for the government in regional elections, early general elections had been called. The leader of the opposition alleged that this was because the Chancellor, Gerhard Schroeder, had a lucrative job coming up in a consortium that would build a gas pipeline from Russia - the contract for which he had helped negotiate whilst in office. German magazine, Bild, wanted to include this allegation in an article it was running.

MLDI is particularly active before the European Court of Human Rights, whose judgments set standards for all 47 States of the Council of Europe and are highly authoritative elsewhere.

The most recent case was in Germany, when the magazine, Bild, challenged an injunction against reporting critical remarks made by the leader of the opposition about former Chancellor Gerhard Schröder.  The court ruled that Bild should establish the truth of the remarks and obtain a response from the former Chancellor before publishing them.
